Nation’s First AI Sandbox and “Intent-Based” Rules Signal Shift in State Tech Policy
Texas Governor Greg Abbott signed the Texas Responsible Artificial Intelligence Governance Act (TRAIGA) into law on June 22, 2025, transforming the Lone Star State into a national laboratory for AI policy. The act, which takes effect on January 1, 2026, introduces intent-focused restrictions, consumer transparency rules, and the country’s first AI regulatory sandbox to strike a balance between innovation and public safety.
The new law represents a decisive intervention in the rapidly evolving field of AI, applying to any person or business offering AI products or developing technology in Texas. By focusing on explicit prohibitions rather than prescriptive compliance rules, Texas aims to attract tech investment while preventing intentional harms.
Prohibition Over Prescriptive Compliance
Unlike sweeping European or Californian AI frameworks, TRAIGA narrows its scope to a unique set of intentional prohibitions. Texas bars the creation or deployment of AI systems that intentionally incite or encourage violence, self-harm, or criminal activity. Systems designed with the sole intent to infringe on constitutional rights or unlawfully discriminate against protected classes are strictly forbidden.
The act specifically outlaws the development and distribution of AI tools for producing child pornography, nonconsensual sexually explicit deepfakes, or chatbots that imitate children in explicit contexts. These rules address mounting public concern over the potential for AI misuse in both digital and physical spaces.
“TRAIGA brings forth a new approach to AI regulation, both by limiting Texas’ ability to punish companies with prohibitions on only a few intentional harms and by expanding the state’s investigatory powers,” Tech Policy Press reported.
Government Use
TRAIGA introduces additional requirements and restrictions for government actors deploying AI. Agencies must provide clear, conspicuous notification—written in plain language—when citizens interact with AI-enabled public services.
In a direct rebuke of “social credit” style oversight, state and local government use of AI to evaluate or classify individuals or groups based on behavior, appearance, or personal traits with the intention of assigning harmful “social scores” is expressly prohibited. The law also restricts the use of biometric identification by public agencies, unless the individual consents or is subject to exceptions for essential security or law enforcement purposes.
Private healthcare providers, in turn, must notify patients whenever they are interacting with an AI system as part of their care, a proactive move to address rising concerns about transparency in digital health.
Intent-Based Liability
A pillar of TRAIGA is its “intent-based” liability framework. Rather than hold companies responsible for any algorithmic outcome, Texas requires regulators to show developers and deployers “knowingly and intentionally” misused AI to trigger enforcement. This higher legal bar aims to protect good-faith actors and startups from punishments over inadvertent or emergent harms—a notable contrast to outcome-based frameworks.
To enforce the act, Texas vests exclusive authority in the Attorney General. Regulated parties who receive a notice of violation have a 60-day period to cure, shielding them from immediate lawsuits and fostering a climate of remediation. Civil penalties can reach $200,000 per major violation and $40,000 per day for ongoing problems. The act eliminates private rights of action, centralizing oversight and reducing legal uncertainty for businesses.

Creating the First AI Regulatory Sandbox
In perhaps its most innovative step, Texas establishes a state-administered AI regulatory sandbox. For up to 36 months, approved companies can test new AI applications—including experimental healthcare, finance, or educational tools—under regulatory supervision and with certain license requirements temporarily relaxed.
Program participants must submit detailed applications, report quarterly on metrics and consumer impacts, and agree to oversight by the Texas Department of Information Resources in consultation with the newly formed Texas Artificial Intelligence Council. However, if a project crosses the line and violates any core prohibition—including intentional harm or discrimination—sandbox status offers no immunity.
“TRAIGA establishes a Sandbox Program, a state-administered testing environment to promote AI’s use, particularly in healthcare, finance, education, and public services. ... [It] provides only a shallow safe harbor,” Tech Policy Press noted.
The Texas AI Council
TRAIGA establishes the Texas Artificial Intelligence Council, a bipartisan, seven-member body appointed by the governor and legislative leaders. This group is tasked with monitoring public-sector AI, advising on ethics, and recommending administrative guardrails as technology advances. Its presence aims to keep the law up to date, promote safe use, and avoid the pitfalls of static, one-size-fits-all rules.
“The council will study and monitor artificial intelligence technology developed, employed, or procured by Texas state agencies,” the Governor’s office stated, underlining the focus on public transparency and evolving rigorous standards.

In parallel with its AI rules, TRAIGA amends Texas privacy statutes regarding biometric data. The law maintains rigid consent requirements for extracting biometric information from online media for commercial purposes, but creates limited exceptions for certain AI training needs.
